ADDITIONAL INFORMATION ON CALTON

Calton Grisham was born about 1795 in Lincoln County, KY.  His name appears on legal documents with different spellings, such as:  Carlton, Colton and or Calton Grisham, Gresham, Grissum or Grissom.  Calton died on September 22, 1836 in Morgan County, Indiana.  His 160 acres at the time of his death in 1836 was settled in Probate Court in 1849 in Morgan County, Indiana.

May 15, 1849 documentation of petition to the Probate Court in Morgan County, Indiana, 13 years after Carlton’s death in 1836.

Nancy Grisham, Williamson Grisham, Thomas Ely and Martha Jane (Grisham) Ely
Vs.
Edward Grisham, Nelson Grisham and Thomas Grisham

The first parties would represent to the court that Carlton, deceased, died in possession of 160 acres and that Nancy, his widow, Williamson, Thomas and Martha (Grisham) Ely and Edward of full age and Nelson and Thomas Grisham under age twenty one are the heirs at law of said Carlton Grisham, deceased.  (Thomas was approximately 13 years old).  They represented to the court that they were all tenants in common and each entitled to one sixth part.  Wesley Grisham, deceased, was one of the heirs of Carlton Grisham, and during his lifetime was entitled to one sixth part of said real estate and Nancy Grisham was entitled to one half of Wesley’s one sixth and the rest divided equally among the surviving children of Carlton and Nancy.  They were asking for a commissioner for assignment.  At the February 12, 1849 Probate Court date, Petitioners now amend their petition the guardian of said minor descendants now filing her assent on an motion the said defendant Edward Grisham is now solemnly called and comes not but makes default herein.  Larken Reynolds is appointed guardian “for said infant defendants” Nelson and Thomas C.  (** Until the last century, a mother had no legal custody of her children so the term “orphan” or infant defendants could mean only the father was dead, re: www.genealogytoday) Larken Reynolds “knows of no cause why the petition should not be granted.  However it was adjudged by the court that said widow, Nancy Grisham, recover one third part of the lands and the remainder be parted and divided aas one twelfth part thereof be set apart and assigned to Nancy Grisham as the heir at law of Wesley Grisham deceased, and that the balance of said lands be parted and divided equally among heirs.  Three commissioners were assigned to divide the property and their decision was recorded May 15, 1849.

This information comes from a report done by Wanda Brown of Martinsville, Illinois.  Wanda is a descendant of Thomas C. Grisham.
